Policy Statement<\/strong><\/h2>\n<p data-start=\"599\" data-end=\"1050\">Health and Beauty Canadian College (\u201cthe College\u201d) is committed to providing students with a fair, respectful, transparent, and timely process for resolving complaints. The College recognizes that students have the right to raise concerns regarding academic matters, services, facilities, policies, or conduct, and to expect those concerns to be addressed in accordance with principles of <strong data-start=\"988\" data-end=\"1049\">natural justice, procedural fairness, and confidentiality<\/strong>.<\/p>\n<p data-start=\"1052\" data-end=\"1255\">This policy complies with the requirements of the <strong data-start=\"1102\" data-end=\"1131\">Career Colleges Act, 2005<\/strong>, the <strong data-start=\"1137\" data-end=\"1183\">Approval of Programs of Instruction Policy<\/strong>, and applicable Ministry of Colleges and Universities (MCU) guidelines.<\/p>\n<hr data-start=\"1257\" data-end=\"1260\" \/>\n<h2 data-start=\"1262\" data-end=\"1293\"><strong data-start=\"1265\" data-end=\"1293\">2. Scope and Eligibility<\/strong><\/h2>\n<p data-start=\"1295\" data-end=\"1318\">This policy applies to:<\/p>\n<ul data-start=\"1319\" data-end=\"1518\">\n<li data-start=\"1319\" data-end=\"1355\">\n<p data-start=\"1321\" data-end=\"1355\">Full-time and part-time students<\/p>\n<\/li>\n<li data-start=\"1356\" data-end=\"1386\">\n<p data-start=\"1358\" data-end=\"1386\">Online and hybrid students<\/p>\n<\/li>\n<li data-start=\"1387\" data-end=\"1441\">\n<p data-start=\"1389\" data-end=\"1441\">Students currently enrolled in a program or course<\/p>\n<\/li>\n<li data-start=\"1442\" data-end=\"1518\">\n<p data-start=\"1444\" data-end=\"1518\">Former students, <strong data-start=\"1461\" data-end=\"1518\">provided the incident occurred during their enrolment<\/strong><\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1520\" data-end=\"1582\">Anonymous complaints will not be considered under this policy.<\/p>\n<hr data-start=\"1584\" data-end=\"1587\" \/>\n<h2 data-start=\"1589\" data-end=\"1613\"><strong data-start=\"1592\" data-end=\"1613\">3. Student Rights<\/strong><\/h2>\n<p data-start=\"1615\" data-end=\"1642\">Students have the right to:<\/p>\n<ul data-start=\"1643\" data-end=\"2006\">\n<li data-start=\"1643\" data-end=\"1698\">\n<p data-start=\"1645\" data-end=\"1698\">Present their complaint without fear of retaliation<\/p>\n<\/li>\n<li data-start=\"1699\" data-end=\"1769\">\n<p data-start=\"1701\" data-end=\"1769\">Be accompanied by a support person of their choice during meetings<\/p>\n<\/li>\n<li data-start=\"1770\" data-end=\"1823\">\n<p data-start=\"1772\" data-end=\"1823\">Receive written responses within stated timelines<\/p>\n<\/li>\n<li data-start=\"1824\" data-end=\"1868\">\n<p data-start=\"1826\" data-end=\"1868\">Confidential handling of their complaint<\/p>\n<\/li>\n<li data-start=\"1869\" data-end=\"1920\">\n<p data-start=\"1871\" data-end=\"1920\">Appeal decisions in accordance with this policy<\/p>\n<\/li>\n<li data-start=\"1921\" data-end=\"2006\">\n<p data-start=\"1923\" data-end=\"2006\">Escalate unresolved complaints to the <strong data-start=\"1961\" data-end=\"2006\">Superintendent of Ontario Career Colleges<\/strong><\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"2008\" data-end=\"2011\" \/>\n<h2 data-start=\"2013\" data-end=\"2041\"><strong data-start=\"2016\" data-end=\"2041\">4. Guiding Principles<\/strong><\/h2>\n<p data-start=\"2043\" data-end=\"2066\">The College commits to:<\/p>\n<ul data-start=\"2067\" data-end=\"2342\">\n<li data-start=\"2067\" data-end=\"2113\">\n<p data-start=\"2069\" data-end=\"2113\">Acting fairly, reasonably, and impartially<\/p>\n<\/li>\n<li data-start=\"2114\" data-end=\"2152\">\n<p data-start=\"2116\" data-end=\"2152\">Following its published procedures<\/p>\n<\/li>\n<li data-start=\"2153\" data-end=\"2199\">\n<p data-start=\"2155\" data-end=\"2199\">Respecting confidentiality (not anonymity)<\/p>\n<\/li>\n<li data-start=\"2200\" data-end=\"2258\">\n<p data-start=\"2202\" data-end=\"2258\">Making decisions based on the balance of probabilities<\/p>\n<\/li>\n<li data-start=\"2259\" data-end=\"2342\">\n<p data-start=\"2261\" data-end=\"2342\">Ensuring students are not disadvantaged for submitting complaints in good faith<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"2344\" data-end=\"2347\" \/>\n<h2 data-start=\"2349\" data-end=\"2368\"><strong data-start=\"2352\" data-end=\"2368\">5. Timelines<\/strong><\/h2>\n<ul data-start=\"2370\" data-end=\"2624\">\n<li data-start=\"2370\" data-end=\"2455\">\n<p data-start=\"2372\" data-end=\"2455\">Complaints must normally be submitted <strong data-start=\"2410\" data-end=\"2437\">within 30 calendar days<\/strong> of the incident<\/p>\n<\/li>\n<li data-start=\"2456\" data-end=\"2551\">\n<p data-start=\"2458\" data-end=\"2551\">Timelines may be extended at the College\u2019s discretion where extenuating circumstances exist<\/p>\n<\/li>\n<li data-start=\"2552\" data-end=\"2624\">\n<p data-start=\"2554\" data-end=\"2624\">Students will be informed in writing if timelines require adjustment<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"2626\" data-end=\"2629\" \/>\n<h2 data-start=\"2631\" data-end=\"2669\"><strong data-start=\"2634\" data-end=\"2669\">6. Complaint Resolution Process<\/strong><\/h2>\n<h3 data-start=\"2671\" data-end=\"2707\"><strong data-start=\"2675\" data-end=\"2707\">Step 1 \u2013 Informal Resolution<\/strong><\/h3>\n<p data-start=\"2709\" data-end=\"2782\">Students are encouraged to resolve concerns informally whenever possible.<\/p>\n<ol data-start=\"2784\" data-end=\"3102\">\n<li data-start=\"2784\" data-end=\"2882\">\n<p data-start=\"2787\" data-end=\"2882\">The student raises the concern directly with the instructor, staff member, or manager involved.<\/p>\n<\/li>\n<li data-start=\"2883\" data-end=\"2920\">\n<p data-start=\"2886\" data-end=\"2920\">Concerns may be verbal or written.<\/p>\n<\/li>\n<li data-start=\"2921\" data-end=\"2982\">\n<p data-start=\"2924\" data-end=\"2982\">Both parties attempt to resolve the issue collaboratively.<\/p>\n<\/li>\n<li data-start=\"2983\" data-end=\"3041\">\n<p data-start=\"2986\" data-end=\"3041\">A facilitated discussion or mediation may be requested.<\/p>\n<\/li>\n<li data-start=\"3042\" data-end=\"3102\">\n<p data-start=\"3045\" data-end=\"3102\">If resolved, the outcome is documented where appropriate.<\/p>\n<\/li>\n<\/ol>\n<p data-start=\"3104\" data-end=\"3153\">If unresolved, the student may proceed to Step 2.<\/p>\n<hr data-start=\"3155\" data-end=\"3158\" \/>\n<h3 data-start=\"3160\" data-end=\"3204\"><strong data-start=\"3164\" data-end=\"3204\">Step 2 \u2013 Formal Complaint Resolution<\/strong><\/h3>\n<ol data-start=\"3206\" data-end=\"4013\">\n<li data-start=\"3206\" data-end=\"3478\">\n<p data-start=\"3209\" data-end=\"3321\">The student submits a <strong data-start=\"3231\" data-end=\"3259\">written formal complaint<\/strong> to the Campus Manager or designated administrator, including:<\/p>\n<ul data-start=\"3325\" data-end=\"3478\">\n<li data-start=\"3325\" data-end=\"3355\">\n<p data-start=\"3327\" data-end=\"3355\">Description of the concern<\/p>\n<\/li>\n<li data-start=\"3359\" data-end=\"3396\">\n<p data-start=\"3361\" data-end=\"3396\">Date(s) and time(s) of occurrence<\/p>\n<\/li>\n<li data-start=\"3400\" data-end=\"3424\">\n<p data-start=\"3402\" data-end=\"3424\">Individuals involved<\/p>\n<\/li>\n<li data-start=\"3428\" data-end=\"3453\">\n<p data-start=\"3430\" data-end=\"3453\">Actions taken to date<\/p>\n<\/li>\n<li data-start=\"3457\" data-end=\"3478\">\n<p data-start=\"3459\" data-end=\"3478\">Resolution sought<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li data-start=\"3480\" data-end=\"3646\">\n<p data-start=\"3483\" data-end=\"3507\">The Campus Manager will:<\/p>\n<ul data-start=\"3511\" data-end=\"3646\">\n<li data-start=\"3511\" data-end=\"3534\">\n<p data-start=\"3513\" data-end=\"3534\">Acknowledge receipt<\/p>\n<\/li>\n<li data-start=\"3538\" data-end=\"3590\">\n<p data-start=\"3540\" data-end=\"3590\">Meet with the student <strong data-start=\"3562\" data-end=\"3590\">within 2\u20133 business days<\/strong><\/p>\n<\/li>\n<li data-start=\"3594\" data-end=\"3646\">\n<p data-start=\"3596\" data-end=\"3646\">Investigate the complaint fairly and impartially<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li data-start=\"3648\" data-end=\"3727\">\n<p data-start=\"3651\" data-end=\"3727\">The employee\/respondent will be given the opportunity to respond in writing.<\/p>\n<\/li>\n<li data-start=\"3729\" data-end=\"3901\">\n<p data-start=\"3732\" data-end=\"3807\">A written decision will be issued <strong data-start=\"3766\" data-end=\"3795\">within 5\u201310 business days<\/strong>, outlining:<\/p>\n<ul data-start=\"3811\" data-end=\"3901\">\n<li data-start=\"3811\" data-end=\"3823\">\n<p data-start=\"3813\" data-end=\"3823\">Findings<\/p>\n<\/li>\n<li data-start=\"3827\" data-end=\"3839\">\n<p data-start=\"3829\" data-end=\"3839\">Decision<\/p>\n<\/li>\n<li data-start=\"3843\" data-end=\"3871\">\n<p data-start=\"3845\" data-end=\"3871\">Reasons for the decision<\/p>\n<\/li>\n<li data-start=\"3875\" data-end=\"3901\">\n<p data-start=\"3877\" data-end=\"3901\">Any corrective actions<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li data-start=\"3903\" data-end=\"4013\">\n<p data-start=\"3906\" data-end=\"4013\">All documentation will be retained in the <strong data-start=\"3948\" data-end=\"3976\">Student Complaint Binder<\/strong> for <strong data-start=\"3981\" data-end=\"4012\">a minimum of four (4) years<\/strong>.<\/p>\n<\/li>\n<\/ol>\n<p data-start=\"4015\" data-end=\"4078\">Complaints submitted via social media will not be acknowledged.<\/p>\n<hr data-start=\"4080\" data-end=\"4083\" \/>\n<h3 data-start=\"4085\" data-end=\"4108\"><strong data-start=\"4089\" data-end=\"4108\">Step 3 \u2013 Appeal<\/strong><\/h3>\n<p data-start=\"4110\" data-end=\"4134\">A student may appeal if:<\/p>\n<ul data-start=\"4135\" data-end=\"4239\">\n<li data-start=\"4135\" data-end=\"4167\">\n<p data-start=\"4137\" data-end=\"4167\">Due process was not followed<\/p>\n<\/li>\n<li data-start=\"4168\" data-end=\"4201\">\n<p data-start=\"4170\" data-end=\"4201\">The decision was unreasonable<\/p>\n<\/li>\n<li data-start=\"4202\" data-end=\"4239\">\n<p data-start=\"4204\" data-end=\"4239\">New material evidence has emerged<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"4241\" data-end=\"4339\"><strong data-start=\"4241\" data-end=\"4305\">Appeals must be submitted in writing within 10 business days<\/strong> of receiving the Step 2 decision.<\/p>\n<p data-start=\"4341\" data-end=\"4383\">The Director or Senior Administrator will:<\/p>\n<ul data-start=\"4384\" data-end=\"4514\">\n<li data-start=\"4384\" data-end=\"4412\">\n<p data-start=\"4386\" data-end=\"4412\">Review all documentation<\/p>\n<\/li>\n<li data-start=\"4413\" data-end=\"4453\">\n<p data-start=\"4415\" data-end=\"4453\">Conduct further inquiry if necessary<\/p>\n<\/li>\n<li data-start=\"4454\" data-end=\"4514\">\n<p data-start=\"4456\" data-end=\"4514\">Issue a final written decision within <strong data-start=\"4494\" data-end=\"4514\">10 business days<\/strong><\/p>\n<\/li>\n<\/ul>\n<p data-start=\"4516\" data-end=\"4566\">This decision is final at the institutional level.<\/p>\n<hr data-start=\"4568\" data-end=\"4571\" \/>\n<h2 data-start=\"4573\" data-end=\"4618\"><strong data-start=\"4576\" data-end=\"4618\">7. External Complaint Resolution (MCU)<\/strong><\/h2>\n<p data-start=\"4620\" data-end=\"4741\">If the complaint remains unresolved, the student may submit a complaint to the Superintendent of Ontario Career Colleges:<\/p>\n<p data-start=\"4743\" data-end=\"4880\"><strong data-start=\"4743\" data-end=\"4780\">Superintendent of Career Colleges<\/strong><br data-start=\"4780\" data-end=\"4783\" \/>Ministry of Colleges and Universities<br data-start=\"4820\" data-end=\"4823\" \/>77 Wellesley Street West, Box 977<br data-start=\"4856\" data-end=\"4859\" \/>Toronto, ON M7A 1N3<\/p>\n<p data-start=\"4882\" data-end=\"4994\">Complaints must be submitted through <strong data-start=\"4919\" data-end=\"4928\">PARIS<\/strong>:<br data-start=\"4929\" data-end=\"4932\" \/><a class=\"decorated-link\" href=\"https:\/\/www.pcc.tcu.gov.on.ca\/PARISExtWeb\/public\/login.xhtml\" target=\"_new\" rel=\"noopener\" data-start=\"4932\" data-end=\"4992\">https:\/\/www.pcc.tcu.gov.on.ca\/PARISExtWeb\/public\/login.xhtml<\/a><\/p>\n<hr data-start=\"4996\" data-end=\"4999\" \/>\n<h2 data-start=\"5001\" data-end=\"5027\"><strong data-start=\"5004\" data-end=\"5027\">8. Group Complaints<\/strong><\/h2>\n<ul data-start=\"5029\" data-end=\"5155\">\n<li data-start=\"5029\" data-end=\"5068\">\n<p data-start=\"5031\" data-end=\"5068\">Groups may appoint a representative<\/p>\n<\/li>\n<li data-start=\"5069\" data-end=\"5100\">\n<p data-start=\"5071\" data-end=\"5100\">Written consent is required<\/p>\n<\/li>\n<li data-start=\"5101\" data-end=\"5155\">\n<p data-start=\"5103\" data-end=\"5155\">Findings will be shared with all affected students<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"5157\" data-end=\"5160\" \/>\n<h2 data-start=\"5162\" data-end=\"5199\"><strong data-start=\"5165\" data-end=\"5199\">9. Confidentiality and Records<\/strong><\/h2>\n<ul data-start=\"5201\" data-end=\"5389\">\n<li data-start=\"5201\" data-end=\"5246\">\n<p data-start=\"5203\" data-end=\"5246\">All complaints are handled confidentially<\/p>\n<\/li>\n<li data-start=\"5247\" data-end=\"5308\">\n<p data-start=\"5249\" data-end=\"5308\">Information is disclosed strictly on a need-to-know basis<\/p>\n<\/li>\n<li data-start=\"5309\" data-end=\"5344\">\n<p data-start=\"5311\" data-end=\"5344\">Records are securely maintained<\/p>\n<\/li>\n<li data-start=\"5345\" data-end=\"5389\">\n<p data-start=\"5347\" data-end=\"5389\">Confidentiality does not imply anonymity<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"5391\" data-end=\"5394\" \/>\n<h2 data-start=\"5396\" data-end=\"5440\"><strong data-start=\"5399\" data-end=\"5440\">10. Frivolous or Vexatious Complaints<\/strong><\/h2>\n<p data-start=\"5442\" data-end=\"5502\">Complaints may be deemed frivolous or vexatious if they are:<\/p>\n<ul data-start=\"5503\" data-end=\"5597\">\n<li data-start=\"5503\" data-end=\"5530\">\n<p data-start=\"5505\" data-end=\"5530\">Repetitive or harassing<\/p>\n<\/li>\n<li data-start=\"5531\" data-end=\"5565\">\n<p data-start=\"5533\" data-end=\"5565\">Malicious or made in bad faith<\/p>\n<\/li>\n<li data-start=\"5566\" data-end=\"5597\">\n<p data-start=\"5568\" data-end=\"5597\">Unrealistic or unreasonable<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"5599\" data-end=\"5698\">The College reserves the right to terminate such complaints and will notify the student in writing.<\/p>\n<hr data-start=\"5700\" data-end=\"5703\" \/>\n<h2 data-start=\"5705\" data-end=\"5739\"><strong data-start=\"5708\" data-end=\"5739\">11. Authority and Oversight<\/strong><\/h2>\n<ul data-start=\"5741\" data-end=\"5961\">\n<li data-start=\"5741\" data-end=\"5828\">\n<p data-start=\"5743\" data-end=\"5828\"><strong data-start=\"5743\" data-end=\"5781\">Director, Student Support Services<\/strong> is responsible for administering this policy<\/p>\n<\/li>\n<li data-start=\"5829\" data-end=\"5893\">\n<p data-start=\"5831\" data-end=\"5893\">Policy amendments require approval by the College leadership<\/p>\n<\/li>\n<li data-start=\"5894\" data-end=\"5961\">\n<p data-start=\"5896\" data-end=\"5961\">Patterns of complaints are monitored for continuous improvement<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"5963\" data-end=\"5966\" \/>\n<h2 data-start=\"5968\" data-end=\"5986\"><strong data-start=\"5971\" data-end=\"5986\">12. Privacy<\/strong><\/h2>\n<p data-start=\"5988\" data-end=\"6161\">Personal information collected is authorized under the <strong data-start=\"6043\" data-end=\"6107\">Freedom of Information and Protection of Privacy Act (FIPPA)<\/strong> and is used solely for complaint resolution purposes.<\/p>\n<hr data-start=\"6163\" data-end=\"6166\" \/>\n<h2 data-start=\"6168\" data-end=\"6184\"><strong data-start=\"6171\" data-end=\"6184\">13.
