Purpose and Legislative Authority<\/strong><\/h2>\n<p data-start=\"509\" data-end=\"863\">Health and Beauty Canadian College (\u201cHBCC\u201d or \u201cthe College\u201d) is committed to maintaining a learning environment that is safe, respectful, and free from sexual violence and sexual harassment. This policy is established in accordance with the <strong data-start=\"750\" data-end=\"787\">Ontario Career Colleges Act, 2005<\/strong> and <strong data-start=\"792\" data-end=\"850\">Ontario Regulation 415\/06 (General), subsection 36.0.2<\/strong>, as amended.<\/p>\n<p data-start=\"865\" data-end=\"1132\">On September 16, 2021, the Ministry announced regulatory changes to strengthen protections for post-secondary students who experience sexual violence or sexual harassment. These amendments came into effect on <strong data-start=\"1074\" data-end=\"1091\">March 1, 2022<\/strong>, and are fully reflected in this policy.<\/p>\n<p data-start=\"1134\" data-end=\"1199\">This policy applies to <strong data-start=\"1157\" data-end=\"1173\">all students<\/strong>, whether incidents occur:<\/p>\n<ul data-start=\"1200\" data-end=\"1351\">\n<li data-start=\"1200\" data-end=\"1211\">\n<p data-start=\"1202\" data-end=\"1211\">On campus<\/p>\n<\/li>\n<li data-start=\"1212\" data-end=\"1257\">\n<p data-start=\"1214\" data-end=\"1257\">During college-related activities or events<\/p>\n<\/li>\n<li data-start=\"1258\" data-end=\"1306\">\n<p data-start=\"1260\" data-end=\"1306\">During internships, placements, or externships<\/p>\n<\/li>\n<li data-start=\"1307\" data-end=\"1351\">\n<p data-start=\"1309\" data-end=\"1351\">In virtual or online learning environments<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"1353\" data-end=\"1356\" \/>\n<h2 data-start=\"1358\" data-end=\"1403\"><strong data-start=\"1361\" data-end=\"1403\">2. Regulatory Protections for Students<\/strong><\/h2>\n<p data-start=\"1405\" data-end=\"1490\">In accordance with <strong data-start=\"1424\" data-end=\"1463\">Ontario Regulation 415\/06, s.36.0.2<\/strong>, the College affirms that:<\/p>\n<ol data-start=\"1492\" data-end=\"2111\">\n<li data-start=\"1492\" data-end=\"1798\">\n<p data-start=\"1495\" data-end=\"1798\"><strong data-start=\"1495\" data-end=\"1536\">No Discipline for Drug or Alcohol Use<\/strong><br data-start=\"1536\" data-end=\"1539\" \/>A student who, in good faith, reports an incident of sexual violence or makes a complaint <strong data-start=\"1632\" data-end=\"1682\">will not be subject to discipline or sanctions<\/strong> for violations of College policies related to drug or alcohol use at the time the alleged sexual violence occurred.<\/p>\n<\/li>\n<li data-start=\"1800\" data-end=\"2111\">\n<p data-start=\"1803\" data-end=\"2033\"><strong data-start=\"1803\" data-end=\"1845\">Protection from Irrelevant Questioning<\/strong><br data-start=\"1845\" data-end=\"1848\" \/>Students who disclose sexual violence\u2014whether through reporting, making a complaint, or accessing supports\u2014<strong data-start=\"1958\" data-end=\"2000\">will not be asked irrelevant questions<\/strong>, including questions related to:<\/p>\n<ul data-start=\"2037\" data-end=\"2111\">\n<li data-start=\"2037\" data-end=\"2058\">\n<p data-start=\"2039\" data-end=\"2058\">Sexual expression<\/p>\n<\/li>\n<li data-start=\"2062\" data-end=\"2084\">\n<p data-start=\"2064\" data-end=\"2084\">Sexual orientation<\/p>\n<\/li>\n<li data-start=\"2088\" data-end=\"2111\">\n<p data-start=\"2090\" data-end=\"2111\">Past sexual history<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<hr data-start=\"2113\" data-end=\"2116\" \/>\n<h2 data-start=\"2118\" data-end=\"2144\"><strong data-start=\"2121\" data-end=\"2144\">3. Policy Statement<\/strong><\/h2>\n<p data-start=\"2146\" data-end=\"2197\">Health and Beauty Canadian College is committed to:<\/p>\n<ul data-start=\"2198\" data-end=\"2493\">\n<li data-start=\"2198\" data-end=\"2292\">\n<p data-start=\"2200\" data-end=\"2292\">Treating all individuals affected by sexual violence with <strong data-start=\"2258\" data-end=\"2292\">dignity, fairness, and respect<\/strong><\/p>\n<\/li>\n<li data-start=\"2293\" data-end=\"2347\">\n<p data-start=\"2295\" data-end=\"2347\">Ensuring <strong data-start=\"2304\" data-end=\"2347\">confidential, trauma-informed responses<\/strong><\/p>\n<\/li>\n<li data-start=\"2348\" data-end=\"2425\">\n<p data-start=\"2350\" data-end=\"2425\">Providing access to <strong data-start=\"2370\" data-end=\"2425\">support services without requiring formal reporting<\/strong><\/p>\n<\/li>\n<li data-start=\"2426\" data-end=\"2493\">\n<p data-start=\"2428\" data-end=\"2493\">Ensuring fair, impartial, and timely investigations when required<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2495\" data-end=\"2527\">For the purposes of this policy:<\/p>\n<ul data-start=\"2528\" data-end=\"2719\">\n<li data-start=\"2528\" data-end=\"2622\">\n<p data-start=\"2530\" data-end=\"2622\">The individual reporting or disclosing sexual violence is referred to as the <strong data-start=\"2607\" data-end=\"2622\">Complainant<\/strong><\/p>\n<\/li>\n<li data-start=\"2623\" data-end=\"2719\">\n<p data-start=\"2625\" data-end=\"2719\">The individual alleged to have engaged in sexual violence is referred to as the <strong data-start=\"2705\" data-end=\"2719\">Respondent<\/strong><\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"2721\" data-end=\"2724\" \/>\n<h2 data-start=\"2726\" data-end=\"2765\"><strong data-start=\"2729\" data-end=\"2765\">4. Definition of Sexual Violence<\/strong><\/h2>\n<p data-start=\"2767\" data-end=\"2881\">Sexual violence includes <strong data-start=\"2792\" data-end=\"2820\">any act or attempted act<\/strong>, whether physical or psychological, that targets a person\u2019s:<\/p>\n<ul data-start=\"2882\" data-end=\"2931\">\n<li data-start=\"2882\" data-end=\"2893\">\n<p data-start=\"2884\" data-end=\"2893\">Sexuality<\/p>\n<\/li>\n<li data-start=\"2894\" data-end=\"2911\">\n<p data-start=\"2896\" data-end=\"2911\">Gender identity<\/p>\n<\/li>\n<li data-start=\"2912\" data-end=\"2931\">\n<p data-start=\"2914\" data-end=\"2931\">Gender expression<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2933\" data-end=\"2996\"><strong data-start=\"2933\" data-end=\"2965\">Without the person\u2019s consent<\/strong>, including but not limited to:<\/p>\n<ul data-start=\"2997\" data-end=\"3156\">\n<li data-start=\"2997\" data-end=\"3013\">\n<p data-start=\"2999\" data-end=\"3013\">Sexual assault<\/p>\n<\/li>\n<li data-start=\"3014\" data-end=\"3033\">\n<p data-start=\"3016\" data-end=\"3033\">Sexual harassment<\/p>\n<\/li>\n<li data-start=\"3034\" data-end=\"3055\">\n<p data-start=\"3036\" data-end=\"3055\">Sexual exploitation<\/p>\n<\/li>\n<li data-start=\"3056\" data-end=\"3066\">\n<p data-start=\"3058\" data-end=\"3066\">Stalking<\/p>\n<\/li>\n<li data-start=\"3067\" data-end=\"3078\">\n<p data-start=\"3069\" data-end=\"3078\">Voyeurism<\/p>\n<\/li>\n<li data-start=\"3079\" data-end=\"3108\">\n<p data-start=\"3081\" data-end=\"3108\">Indecent or sexual exposure<\/p>\n<\/li>\n<li data-start=\"3109\" data-end=\"3156\">\n<p data-start=\"3111\" data-end=\"3156\">Distribution of sexual images without consent<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"3158\" data-end=\"3161\" \/>\n<h2 data-start=\"3163\" data-end=\"3205\"><strong data-start=\"3166\" data-end=\"3205\">5. Policy Distribution and Training<\/strong><\/h2>\n<ul data-start=\"3207\" data-end=\"3570\">\n<li data-start=\"3207\" data-end=\"3298\">\n<p data-start=\"3209\" data-end=\"3298\">A copy of this policy is provided to all students as part of their <strong data-start=\"3276\" data-end=\"3298\">enrolment contract<\/strong><\/p>\n<\/li>\n<li data-start=\"3299\" data-end=\"3352\">\n<p data-start=\"3301\" data-end=\"3352\">The policy is made available on the College website<\/p>\n<\/li>\n<li data-start=\"3353\" data-end=\"3570\">\n<p data-start=\"3355\" data-end=\"3440\">All faculty, instructors, staff, management, and contractors receive <strong data-start=\"3424\" data-end=\"3436\">training<\/strong> on:<\/p>\n<ul data-start=\"3443\" data-end=\"3570\">\n<li data-start=\"3443\" data-end=\"3466\">\n<p data-start=\"3445\" data-end=\"3466\">Reporting obligations<\/p>\n<\/li>\n<li data-start=\"3469\" data-end=\"3496\">\n<p data-start=\"3471\" data-end=\"3496\">Trauma-informed responses<\/p>\n<\/li>\n<li data-start=\"3499\" data-end=\"3525\">\n<p data-start=\"3501\" data-end=\"3525\">Investigation procedures<\/p>\n<\/li>\n<li data-start=\"3528\" data-end=\"3570\">\n<p data-start=\"3530\" data-end=\"3570\">Student rights under Ontario legislation<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<hr data-start=\"3572\" data-end=\"3575\" \/>\n<h2 data-start=\"3577\" data-end=\"3620\"><strong data-start=\"3580\" data-end=\"3620\">6. Internship and Placement Partners<\/strong><\/h2>\n<p data-start=\"3622\" data-end=\"3744\">Organizations hosting HBCC students for internships or placements must provide written confirmation that they comply with:<\/p>\n<ul data-start=\"3745\" data-end=\"3896\">\n<li data-start=\"3745\" data-end=\"3780\">\n<p data-start=\"3747\" data-end=\"3780\">The <strong data-start=\"3751\" data-end=\"3780\">Ontario Human Rights Code<\/strong><\/p>\n<\/li>\n<li data-start=\"3781\" data-end=\"3825\">\n<p data-start=\"3783\" data-end=\"3825\">The <strong data-start=\"3787\" data-end=\"3825\">Occupational Health and Safety Act<\/strong><\/p>\n<\/li>\n<li data-start=\"3826\" data-end=\"3896\">\n<p data-start=\"3828\" data-end=\"3896\">Applicable laws related to sexual violence and harassment prevention<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"3898\" data-end=\"3901\" \/>\n<h2 data-start=\"3903\" data-end=\"3945\"><strong data-start=\"3906\" data-end=\"3945\">7. Reporting and Access to Supports<\/strong><\/h2>\n<h3 data-start=\"3947\" data-end=\"3972\">7.1 Reporting Options<\/h3>\n<ul data-start=\"3973\" data-end=\"4164\">\n<li data-start=\"3973\" data-end=\"4050\">\n<p data-start=\"3975\" data-end=\"4050\">Students may report incidents of sexual violence to the <strong data-start=\"4031\" data-end=\"4050\">Campus Director<\/strong><\/p>\n<\/li>\n<li data-start=\"4051\" data-end=\"4164\">\n<p data-start=\"4053\" data-end=\"4164\">College staff who become aware of sexual violence <strong data-start=\"4103\" data-end=\"4118\">must report<\/strong> the matter to the Campus Director immediately<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"4166\" data-end=\"4209\">7.2 Access to Support Without Reporting<\/h3>\n<p data-start=\"4210\" data-end=\"4341\">Students may access supports and services <strong data-start=\"4252\" data-end=\"4340\">without being required to file a formal complaint or participate in an investigation<\/strong>.<\/p>\n<p data-start=\"4343\" data-end=\"4364\">Supports may include:<\/p>\n<ul data-start=\"4365\" data-end=\"4466\">\n<li data-start=\"4365\" data-end=\"4390\">\n<p data-start=\"4367\" data-end=\"4390\">Academic accommodations<\/p>\n<\/li>\n<li data-start=\"4391\" data-end=\"4414\">\n<p data-start=\"4393\" data-end=\"4414\">Counselling referrals<\/p>\n<\/li>\n<li data-start=\"4415\" data-end=\"4448\">\n<p data-start=\"4417\" data-end=\"4448\">Medical and community resources<\/p>\n<\/li>\n<li data-start=\"4449\" data-end=\"4466\">\n<p data-start=\"4451\" data-end=\"4466\">Safety planning<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"4468\" data-end=\"4541\">Students may contact the <strong data-start=\"4493\" data-end=\"4512\">General Manager<\/strong> for confidential assistance.<\/p>\n<p data-start=\"4543\" data-end=\"4732\"><strong data-start=\"4543\" data-end=\"4562\">General Manager<\/strong><br data-start=\"4562\" data-end=\"4565\" \/>Health and Beauty Canadian College<br data-start=\"4599\" data-end=\"4602\" \/>\ud83c\udf10 <a class=\"decorated-link\" href=\"http:\/\/www.healthbeautycollege.com\" target=\"_new\" rel=\"noopener\" data-start=\"4605\" data-end=\"4632\">www.healthbeautycollege.com<\/a><br data-start=\"4632\" data-end=\"4635\" \/>\ud83d\udce7 <a class=\"decorated-link cursor-pointer\" rel=\"noopener\" data-start=\"4638\" data-end=\"4666\">info@healthbeautycollege.com<\/a><br data-start=\"4666\" data-end=\"4669\" \/>\ud83d\udccd 8403 Yonge Street, Thornhill, ON L3T 6R2<br data-start=\"4712\" data-end=\"4715\" \/>\ud83d\udcde 416-917-4747<\/p>\n<hr data-start=\"4734\" data-end=\"4737\" \/>\n<h2 data-start=\"4739\" data-end=\"4787\"><strong data-start=\"4742\" data-end=\"4787\">8. Student Rights and Accommodations<\/strong><\/h2>\n<ul data-start=\"5171\" data-end=\"5508\">\n<li data-start=\"5171\" data-end=\"5255\">\n<p data-start=\"5173\" data-end=\"5255\">Students are <strong data-start=\"5186\" data-end=\"5202\">not required<\/strong> to report incidents or participate in investigations<\/p>\n<\/li>\n<li data-start=\"5256\" data-end=\"5437\">\n<p data-start=\"5258\" data-end=\"5341\">The College may initiate an investigation <strong data-start=\"5300\" data-end=\"5337\">without the Complainant\u2019s consent<\/strong> if:<\/p>\n<ul data-start=\"5344\" data-end=\"5437\">\n<li data-start=\"5344\" data-end=\"5386\">\n<p data-start=\"5346\" data-end=\"5386\">There is a risk to the College community<\/p>\n<\/li>\n<li data-start=\"5389\" data-end=\"5437\">\n<p data-start=\"5391\" data-end=\"5437\">Legal or regulatory obligations require action<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li data-start=\"5438\" data-end=\"5508\">\n<p data-start=\"5440\" data-end=\"5508\">Support services are available <strong data-start=\"5471\" data-end=\"5508\">regardless of reporting decisions<\/strong><\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"5510\" data-end=\"5513\" \/>\n<h2 data-start=\"5515\" data-end=\"5547\"><strong data-start=\"5518\" data-end=\"5547\">10. Investigation Process<\/strong><\/h2>\n<ul data-start=\"5549\" data-end=\"5820\">\n<li data-start=\"5549\" data-end=\"5613\">\n<p data-start=\"5551\" data-end=\"5613\">Reports may be submitted in writing to the <strong data-start=\"5594\" data-end=\"5613\">Campus Director<\/strong><\/p>\n<\/li>\n<li data-start=\"5614\" data-end=\"5820\">\n<p data-start=\"5616\" data-end=\"5647\">The Campus Director determines:<\/p>\n<ul data-start=\"5650\" data-end=\"5820\">\n<li data-start=\"5650\" data-end=\"5697\">\n<p data-start=\"5652\" data-end=\"5697\">Whether an internal investigation is required<\/p>\n<\/li>\n<li data-start=\"5700\" data-end=\"5742\">\n<p data-start=\"5702\" data-end=\"5742\">Whether police notification is necessary<\/p>\n<\/li>\n<li data-start=\"5745\" data-end=\"5820\">\n<p data-start=\"5747\" data-end=\"5820\">Appropriate interim measures (e.g., class changes, separation of parties)<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p data-start=\"5822\" data-end=\"5844\">During investigations:<\/p>\n<ul data-start=\"5845\" data-end=\"6044\">\n<li data-start=\"5845\" data-end=\"5916\">\n<p data-start=\"5847\" data-end=\"5916\">Both the Complainant and Respondent may have a support person present<\/p>\n<\/li>\n<li data-start=\"5917\" data-end=\"5969\">\n<p data-start=\"5919\" data-end=\"5969\">All relevant parties and witnesses are interviewed<\/p>\n<\/li>\n<li data-start=\"5970\" data-end=\"6044\">\n<p data-start=\"5972\" data-end=\"6044\">Investigations are conducted fairly, impartially, and in a timely manner<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"6046\" data-end=\"6049\" \/>\n<h2 data-start=\"6051\" data-end=\"6095\"><strong data-start=\"6054\" data-end=\"6095\">11. Disciplinary Measures and Appeals<\/strong><\/h2>\n<h3 data-start=\"6097\" data-end=\"6126\">11.1 Disciplinary Actions<\/h3>\n<p data-start=\"6127\" data-end=\"6195\">If sexual violence is substantiated, corrective actions may include:<\/p>\n<ul data-start=\"6196\" data-end=\"6280\">\n<li data-start=\"6196\" data-end=\"6215\">\n<p data-start=\"6198\" data-end=\"6215\">Student expulsion<\/p>\n<\/li>\n<li data-start=\"6216\" data-end=\"6235\">\n<p data-start=\"6218\" data-end=\"6235\">Staff termination<\/p>\n<\/li>\n<li data-start=\"6236\" data-end=\"6280\">\n<p data-start=\"6238\" data-end=\"6280\">Suspension or restriction of campus access<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"6282\" data-end=\"6298\">11.2 Appeals<\/h3>\n<ul data-start=\"6299\" data-end=\"6440\">\n<li data-start=\"6299\" data-end=\"6365\">\n<p data-start=\"6301\" data-end=\"6365\">Either party may appeal the decision <strong data-start=\"6338\" data-end=\"6365\">within 10 calendar days<\/strong><\/p>\n<\/li>\n<li data-start=\"6366\" data-end=\"6440\">\n<p data-start=\"6368\" data-end=\"6440\">Appeals must be submitted in writing to the <strong data-start=\"6412\" data-end=\"6440\">President of the College<\/strong><\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"6442\" data-end=\"6445\" \/>\n<h2 data-start=\"6447\" data-end=\"6487\"><strong data-start=\"6450\" data-end=\"6487\">12. False Reports and Retaliation<\/strong><\/h2>\n<ul data-start=\"6489\" data-end=\"6679\">\n<li data-start=\"6489\" data-end=\"6620\">\n<p data-start=\"6491\" data-end=\"6620\">Knowingly making false complaints, providing false information, or engaging in retaliation constitutes a violation of this policy<\/p>\n<\/li>\n<li data-start=\"6621\" data-end=\"6679\">\n<p data-start=\"6623\" data-end=\"6679\">Disciplinary action may include termination or expulsion<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"6681\" data-end=\"6684\" \/>\n<h2 data-start=\"6686\" data-end=\"6728\"><strong data-start=\"6689\" data-end=\"6728\">13. Policy Review and Student Input<\/strong><\/h2>\n<ul data-start=\"6730\" data-end=\"6891\">\n<li data-start=\"6730\" data-end=\"6786\">\n<p data-start=\"6732\" data-end=\"6786\">This policy is reviewed <strong data-start=\"6756\" data-end=\"6786\">at least every three years<\/strong><\/p>\n<\/li>\n<li data-start=\"6787\" data-end=\"6891\">\n<p data-start=\"6789\" data-end=\"6891\">Student input is incorporated into policy development and revisions, as required by Ontario regulation<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"6893\" data-end=\"6896\" \/>\n<h2 data-start=\"6898\" data-end=\"6938\"><strong data-start=\"6901\" data-end=\"6938\">14. Data Collection and Reporting<\/strong><\/h2>\n<p data-start=\"6940\" data-end=\"7123\">Health and Beauty Canadian College collects and submits data related to sexual violence policies and incidents as required under the <strong data-start=\"7073\" data-end=\"7110\">Ontario Career Colleges Act, 2005<\/strong>, as amended.<\/p>\n<hr data-start=\"7125\" data-end=\"7128\" \/>\n<h2 data-start=\"7130\" data-end=\"7161\"><strong data-start=\"7133\" data-end=\"7161\">15.
